Professional Skin Care Influencer Terms of Service
- By requesting to join the Professional Skin Care Influencer Program (“the Program”) you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions.
Eligibility
- Influencers belonging to any category may apply for the Program. Currently, you must have an account on Instagram, TikTok, Twitter, Pinterest or YouTube to qualify. profskincare.com (“Prof.Skin Care”) will review the audience and engagement metrics of your social media presence to determine eligibility, and its determination of eligibility is final and not open to challenge and/or appeal. You cannot simultaneously be a member of the Program and other affiliate programs offered by Prof.Skin Care.
- Once a social media channel is connected to a Prof.Skin Care account, it cannot be connected to other Prof.Skin Care accounts. Only one Prof.Skin Care connection is allowed per social media channel.
- If your application is declined, you must wait 60 days before signing up again using the same account on Instagram, TikTok, Twitter, Pinterest or YouTube.
- Once your application has been approved, you cannot change or remove your connected social media accounts. Please contact Prof.Skin Care`s Customer Service Department if you require the amendment or removal of any of your connected accounts.
General Program Participation
- Your participation in the Program and use of your Rewards Code (as defined below) constitute your full and unconditional agreement to these Terms & Conditions, as well as Prof.Skin Care’s decisions and interpretations, which are final and binding in all matters related to the Program.
Membership Tiers
- The Program consists of three (2) progressive membership tiers: Silver, Gold. All membership tiers enjoy a variety of benefits made available by Prof.Skin Care at its sole discretion from time to time (“Benefits”). Benefits may vary by tier and some tiers may offer more Benefits than others. The type, timing and availability of any Benefits will be determined by Prof.Skin Care at its sole discretion.
- Memberships will be upgraded from their current tier to a higher tier when members achieve certain thresholds of cumulative referred revenue (“Revenue”) during their current membership period, as explained below. Upgrades to higher tiers will occur within one business day of reaching the required Revenue threshold.
- Memberships in the Program, excluding Bronzer memberships, will expire at the end of the twelfth calendar month from the date a membership tier is attained. For example, if a Silver influencer is upgraded to Gold in mid-June then the membership expires at the end of June of the following year. However, if a Silver influencer does not meet the required Revenue to upgrade to Gold during their 12-month membership period, then depending on the Revenue accumulated as a Silver influencer, the influencer will either be renewed for a new 12-month period at the Silver tier or be downgraded to Bronzer.
- When membership levels are attained through upgrade, downgrade or renewal, the influencer’s cumulative referred revenue will be reset to zero.
- Bronzer memberships do not expire.
- Bronzer: No minimum Revenue requirement. A qualified influencer will remain at the Bronzer tier unless the influencer meets the Revenue requirement to upgrade to Silver tier.
- Silver: The influencer generates at least EUR € 300 in Revenue in a 12-month membership period following the silver of their current membership period. As a welcome offer, all new influencers will join at the Silver tier automatically for 12 months upon approval of their application. If an influencer does not quality for Gold or does not re-qualify for Silver during their 12-month membership period, their tier will be downgraded to Bronzer.
- Gold: The influencer generates at least EUR € 2,500 in Revenue in a 12-month membership period following the start of their Silver membership period or the renewal of their Gold membership period. During the following 12-month membership period, if an influencer does not re-qualify for Gold, or their Revenue does not qualify them for the Silver tier, their tier will be downgraded to Bronzer.
- Purpose

- Gold: The influencer generates at least EUR € 2,500 in Revenue in a 12-month membership period following the start of their Silver membership period or the renewal of their Gold membership period. During the following 12-month membership period, if an influencer does not re-qualify for Gold, or their Revenue does not qualify them for the Silver tier, their tier will be downgraded.
- Professional Skin Care reserves the right to terminate from the Program any influencers without any referred revenue after a one-year period.
- Professional Skin Care may, at its sole discretion, alter, limit or modify the Program’s rules, regulations, benefits, eligibility for membership, or any other feature of any particular tier, or may terminate a particular tier at any time without prior notice except as expressly set out in these Terms or required by applicable law.
Rewards Code- You can create your own customized Rewards Code (“Rewards Code”) when applying for the Program.
- The customized Rewards Code must be 7-12 characters in length and must use both capital letters and Arabic numerals.
- If you have an existing Rewards Code obtained from the Professional Skin Care Friend Rewards program, then that Rewards Code will become invalid when your new customized Rewards Code is activated. However, all previous orders made using your original Rewards Code will not be affected.
- You should not customize or promote your Rewards Code in a manner that could be interpreted as impersonating, representing, or claiming relation to a third party in an effort to generate Commission. Rewards Codes that can be interpreted as being customized to resemble existing Rewards Codes belonging to third parties will be automatically deactivated.
- We reserve the right to deactivate your new customized Rewards Code if we find the code to be inappropriate or objectionable at our sole discretion.
Referral- Rewards Codes can be redeemed by New or Returning Customers.
- When using a Rewards Code, customers will receive a discount percentage of either 5% (for New Customers) or 2% (for Returning Customers).
- Bronzer, Silver and Gold influencers:

- Sales are attributed via the "last click", meaning your Rewards Link or Rewards Code must be the last one used by a customer before they place an order at profskincare.com Your Rewards Code must be in the Rewards Link URL that you share to properly attribute the sale to you, or your Rewards Code must be the last one entered before checkout. A 30-day cookie will be dropped into a customer's browser once a Rewards Link is clicked. Any sales made will be attributed to you if no other cookies are recorded before an order is placed. For the avoidance of doubt, Professional Skin Care reserves the right to make the final decision with respect to the attribution of the sale in question to you.
Commission- Commission will be granted once the referred order is fulfilled, and will expire at the end of the sixth month after the Commission was posted to the influencer’s account.
- Influencers may use Commission as a payment method for orders placed at Professional Skin Care. Commission can be applied as payment during the checkout process.
- For orders placed using Commission, Professional Skin Care shall issue refunds in Commission. If the influencer is owed a refund balance beyond what was paid in commission, the outstanding refund balance is issued in Professional Skin Care Credit.
- Commission granted via refunds shall expire at the end of the following month (over 30 days) after the Commission was posted to the influencer’s account.
- Influencers may elect to cash out their Commission after accumulating a total balance of at least US$ 20. Influencers choosing to cash out must provide proper payment account information.
- Cashout payments will be delivered within 5 business days after an influencer chooses to cash out their Commission. Cashout payments will be made in EUR euro, and no additional service fees will be deducted from the final payment amount.
- Influencers cannot request a cashout payment if their Commission total is below the required amount (EUR€ 20). Influencers cannot request a cashout payment for used or expired Commission.
- Professional Skin Care shall not be liable for any loss caused by non-acceptance, rejection or delay of payments, or incorrect payment information.
- PayPal accounts used for Cashout purposes can only be linked to ONE (1) Influencer Account at Professional Skin Care. If a PayPal account is linked to multiple Influencer Accounts, any earned Commission will be forfeit and the PayPal account will be disqualified for Cashout use.
- Should there be any disputes concerning Commission or cashout payments, Professional Skin Care reserves the right to make the final decision.
- Influencer Program Cashout details:

General Promotional Restrictions- Each influencer is only allowed one (1) Professional Skin Care Influencer Account. Extra Influencer Accounts and any corresponding Rewards Codes belonging to a single influencer will be disabled.
- You may share your Rewards Code on your personal blog or personal social media accounts (e.g., Instagram, YouTube, Facebook, Twitter, TikTok, Pinterest, etc.) subject to the terms and conditions of those accounts. However, your social media profile shall not contain an avatar or any other content that could be interpreted as being managed by, or otherwise related to or associated with, Professional Skin Care.
- Your social media account username and Rewards Code cannot include, contain or otherwise resemble the word “Professional Skin Care.” Your Rewards Code also cannot include an existing or previous Professional Skin Care promotion or coupon code.
- You cannot customize your Rewards Code to match any of your social media account usernames. Conversely, you cannot rename any of your social media account usernames to match your Rewards Code.
- Influencers should only operate one social media account per social media platform to promote their Rewards Code. Promotion of a single Rewards Code using multiple accounts belonging to the same social media service is not allowed.
- You are expressly prohibited from posting your Rewards Code on any official Professional Skin Care social media accounts or the Professional Skin Care website (in reviews, social media comments, etc.) in an attempt to generate Commission. You are also prohibited from posting any comments on any official Professional Skin Care social media accounts or the Professional Skin Care website that could be interpreted as promoting or attempting to redirect users to other Internet locations (e.g., websites, or social media accounts or pages) that feature or distribute your Rewards Code.
- You are prohibited from posting your Rewards Code in an attempt to generate Commission, or posting comments that could be interpreted as attempting to promote or distribute your Rewards Code, on any social media accounts or websites owned or operated by entities affiliated with Professional Skin Care, including but not limited to influencers or other entities that participate in the Program.
- Your blog, website or social media pages may not resemble Professional Skin Care’s website or include any content that could imply an affiliation with Professional Skin Care.
- You may email your Rewards Code using your personal email or using the share icon found on Professional Skin Care’s website. However, such emails cannot look as if they are being sent or sponsored by Professional Skin Care.
- You may not create or utilize any client side application (browser plugin, extension, executable, etc.) on any device that might imply affiliation with Professional Skin Care.
- Professional Skin Care reserves the right to immediately void your Commission and/or suspend your Rewards Code if fraudulent promotions or other conduct, including but not limited to the examples listed in these Terms and Conditions, are detected or suspected.
- Professional Skin Care will collaborate with outstanding influencers in the form of giveaways, product reviews or coupons sponsored by Professional Skin Care. Your performance will be reviewed from time to time by Professional Skin Care, and selected influencers will be informed of collaboration opportunities.
Professional Skin Care Sponsored Products- From time to time, Professional Skin Care may offer free products (“Sponsored Products”) to Silver and Gold influencers in exchange for promotional considerations (as defined below).
- All participating influencers claiming and receiving Sponsored Products must create content (“Content”) or, if specified or required by Professional Skin Care, perform promotional activities with Sponsored Products on the Instagram, TikTok, Twitter or Pinterest account, or the YouTube channel they have registered with Professional Skin Care. Influencers must submit links as proof of Content at My Account > Order History.
- Only links to content on Instagram, TikTok , Twitter, Pinterest or YouTube will be considered valid links for proof of Content. Unless specified otherwise, links to other content or social media will not be considered as valid submissions for the purposes of this program.
- Sponsored Products offered are only available while supplies last on a first-come, first-served basis. Only the product option (color, size, etc.) indicated as “free” qualifies as a Sponsored Product. Alternative options do not count as Sponsored Products and will not be given for free.
- Claiming Sponsored Products will only be possible during the time period announced on the Professional Skin Care Influencer page.
- Influencers may only request ONE (1) Sponsored Product per calendar month.
- If an influencer claims a Sponsored Product, and the product is re-offered at any later date, then the influencer is prohibited from claiming the product an additional time. Influencers may only request a specific Sponsored Product ONE (1) time.
- When the influencer adds a Sponsored Product to their Shopping Bag, the item's sale price will be adjusted to “free” automatically if the item is still available.
- Due to limited supplies of Sponsored Products, requests for reshipment will not be honored under any circumstances.
- If supplies of a Sponsored Product are exhausted, or its promotion period ends, the item price will automatically return to the regular price without further notice. If this occurs while a Sponsored Product is placed in a Shopping Bag, the item will automatically be removed.
- If an influencer chooses to check out with only a Sponsored Product in their shopping bag, they are required to pay shipping fees and other miscellaneous or ancillary fees (if any).
- Sponsored Products are non-transferable, and may not be redeemed or resold for cash or Professional Skin Care Credit. Requests to change or cancel existing orders to add a Sponsored Product will not be entertained. Sponsored Products cannot be added to an influencer’s order if the order has already been placed.
How We Share Your Information
Except as described in this privacy policy, Professional Skin Care will not share your personal information with third parties unless you have consented to the disclosure or under the following limited circumstances.
Within Our Corporate Group
Professional Skin Care may share your personal information with other companies in our corporate group.
We have a legitimate interest in sharing your information for internal administrative purposes, in particular to offer the products and services on our website and mobile app and to deal with any inquiries in an efficient and high-quality manner. If you or the relevant Data Controller are located in the EEA, you have the right to object, on grounds relating to your particular situation, at any time to such sharing. To exercise this right you may at any time contact us as provided under "How To Contact Us" below.
Business Transfers
If Professional Skin Care is acquired by or merges with another company, Professional Skin Care may transfer personal information to that company (including transfers made as part of insolvency or bankruptcy proceedings). In such an event, Professional Skin Care will notify you before your personal information is transferred if this information would become subject to a materially different privacy policy.
Service Providers
Professional Skin Care may from time to time share the information we collect from and about you with other third-parties that provide support services to us, or that help us market our products and services. Examples are shipping vendors, billing and refund vendors, payment card processors, promoters and administrators of sweepstakes, contests, giveaways and promotions, and companies that help us improve our product and service offerings and our websites. These companies may need information about you in order to perform their functions. These companies are not authorised to use the information we share with them for any other purpose. In some cases Professional Skin Care and third-party service providers may share tracking information, including your IP address, and Professional Skin Care may provide information about your order to the website that has referred you to Professional Skin Care (and the referral network utilised by such website), to facilitate calculation of any commissions payable by Professional Skin Care.
Aggregate Information
Professional Skin Care may provide aggregate statistics about our customers, sales, traffic patterns, and related website information to third parties, but these statistics will not include any personally identifying information.
Collection and Use of Content- Content related to Professional Skin Care, including but not limited to Content featuring Sponsored Products, that a Professional Skin Care Influencer produces for their social media channels or Content submitted directly to Professional Skin Care by the influencer may be collected by Professional Skin Carefor its own use (including, but not limited to, for marketing purposes). Such Content may consist of such YouTube or TikTok videos, Instagram posts or other social media posts, including text, images, video, and post data created by the influencer that mention Professioanl Skin Care as a sponsor or partner, use Professional Skin Care in a hashtag (e.g., #Professional Skin Care or #prof.skincare), or feature Sponsored Products or other products received from Professional Skin Care as a part of the Program.
- As a Professional Skin Care Influencer and in consideration of being admitted to the Program, you agree to grant Professional Skin Care a non-exclusive and irrevocable right to collect your Content from social media channels and the Professional Skin Care website for marketing, promotional, or analysis purposes. You also agree to grant Professional Skin Care’s business partners a non-exclusive and irrevocable right to publish your Content for marketing, promotional or analysis purposes. Your granting of such rights does not constitute an agreement that any specific Content will be published by Professional Skin Care or Professional Skin Care’s business partners. Any use or publication of your Content shall be at the discretion of Professional Skin Care or Professional Skin Care’s business partners.
- If you do not agree to the collection and use of your Content, you may inform Professional Skin Care and choose to withdraw from the Program anytime.
Membership and status suspension and banning- Influencers will be banned from the Program if they create content featuring Professional Skin Care products or the Professional Skin Care brand name that also includes the following:
- Curses, obscenities or profanity
- Racist or discriminatory content
- Sexual content such as nudity or sexually explicit images or video
- Comments responding to or copying content created by other influencers or content creators
- “Spam” content
- Off-topic discussion
- Influencers will be automatically banned from the Program if they are determined by Professional Skin Care to have caused brand damage by posting and spreading inappropriate content, such as the examples previously listed, via comments or private messages on any social media channels, or have conducted themselves in a manner that could be interpreted as bringing Professional Skin Care into disrepute.
- Influencers will be suspended from claiming Sponsored Products if they request more than one (1) Sponsored Product in a calendar month.
- When claiming Sponsored Products, Influencers will be granted a quota of TWO (2) Sponsored Products that do not have proof of Content. If an influencer receives two Sponsored Products without submitting proof of Content, they will be suspended from the right to claim other Sponsored Products until proof of Content is submitted at My Account > Order History.
- Influencers will be banned from the Program if they perform any of the following actions after claiming Sponsored Products:
- Resell a Sponsored Product to a third party
- Deliberately submit incorrect or invalid proof of Content
- Professional Skin Care reserves the right to immediately void Commission, suspend or ban influencers, and/or void Professional Skin Caremembership (including “Professional Skin Care Influencer” status) if any fraudulent activity, abuse or conduct, including but not limited to the examples listed above, is detected or suspected.
Continuation or Transfer of the Program- You acknowledge and agree that Professional Skin Care reserves the right at its sole discretion to transfer, assign or handover (the “Transfer”) the Program and/or all or any part of its underlying interest and rights (including your eligibility, participation and/or membership in the Program and the underlying content) to another affiliate within the same group structure of Professional Skin Care.
- Professional Skin Care shall notify its influencers of the Transfer in advance (including the new Terms & Conditions, if applicable) by public posting as appropriate, and if the influencer does not agree to the Transfer and/or to be bound by the new Terms & Conditions, the influencer may inform Professional Skin Care within the designated timeframe and choose to withdraw from the Program accordingly. Otherwise, all then eligible influencers shall be automatically enrolled into the new Program according to the then Terms & Conditions (as appropriate).
Liability Disclaimer- By requesting to join the Program you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions.
- Only Professional Skin Care accounts verified with an email address and social media profile can be associated with the Program. Once enrolled in the Program, you will not be eligible to join any other affiliate platforms. Professional Skin Care reserves the right to void Commission, disqualify Professional Skin Care Influencer membership and/or, in extreme cases, take legal actions if any fraudulent activity or abuse is detected or suspected.
- Professional Skin Care reserves the right to terminate, discontinue, modify or cancel the Program at any time and in its sole discretion without notice to you. However, Professional Skin Care will make reasonable efforts to notify members of these changes. Any changes or modifications will be effective immediately upon public posting of the revisions.
- You agree to undertake to obtain and maintain any necessary and applicable licenses and permits required in your jurisdiction to be an influencer, and will indemnify Professional Skin Care against all claims, liabilities, suits, losses, damage and expenses, including costs and reasonable attorney fees, relating to or resulting from failure to obtain or maintain the necessary licenses and permits.
- Should there be any disputes regarding these Terms & Conditions, Professional Skin Care’s decision is final.
- These Terms & Conditions and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, and all relevant parties shall submit to the jurisdiction of the courts of the Hong Kong Special Administrative Region.
- If discrepancies exist between the English Terms & Conditions and other language versions, the English version shall prevail.
- Professional Skin Care reserves the right to make changes to its Terms & Conditions at any time, and you are encouraged to visit this website from time to time for details.
- Professioanl Skin Care may, at its sole discretion, alter, limit or modify the Program’s rules, regulations, benefits, eligibility for membership, or any other feature of any particular tier, or may terminate a particular tier at any time without prior notice except as expressly set out in these Terms or required by applicable law.

- You may share your Rewards Code on your personal blog or personal social media accounts (e.g., Instagram, YouTube, Facebook, Twitter, TikTok, Pinterest, etc.) subject to the terms and conditions of those accounts. However, your social media profile shall not contain an avatar or any other content that could be interpreted as being managed by, or otherwise related to or associated with, Professional Skin Care.
- Your social media account username and Rewards Code cannot include, contain or otherwise resemble the word “Professional Skin Care.” Your Rewards Code also cannot include an existing or previous Professional Skin Care promotion or coupon code.
- You cannot customize your Rewards Code to match any of your social media account usernames. Conversely, you cannot rename any of your social media account usernames to match your Rewards Code.
- Influencers should only operate one social media account per social media platform to promote their Rewards Code. Promotion of a single Rewards Code using multiple accounts belonging to the same social media service is not allowed.
- You are expressly prohibited from posting your Rewards Code on any official Professional Skin Care social media accounts or the Professional Skin Care website (in reviews, social media comments, etc.) in an attempt to generate Commission. You are also prohibited from posting any comments on any official Professional Skin Care social media accounts or the Professional Skin Care website that could be interpreted as promoting or attempting to redirect users to other Internet locations (e.g., websites, or social media accounts or pages) that feature or distribute your Rewards Code.
- You are prohibited from posting your Rewards Code in an attempt to generate Commission, or posting comments that could be interpreted as attempting to promote or distribute your Rewards Code, on any social media accounts or websites owned or operated by entities affiliated with Professional Skin Care, including but not limited to influencers or other entities that participate in the Program.
- Your blog, website or social media pages may not resemble Professional Skin Care’s website or include any content that could imply an affiliation with Professional Skin Care.
- You may email your Rewards Code using your personal email or using the share icon found on Professional Skin Care’s website. However, such emails cannot look as if they are being sent or sponsored by Professional Skin Care.
- You may not create or utilize any client side application (browser plugin, extension, executable, etc.) on any device that might imply affiliation with Professional Skin Care.
- Professional Skin Care reserves the right to immediately void your Commission and/or suspend your Rewards Code if fraudulent promotions or other conduct, including but not limited to the examples listed in these Terms and Conditions, are detected or suspected.
- Professional Skin Care will collaborate with outstanding influencers in the form of giveaways, product reviews or coupons sponsored by Professional Skin Care. Your performance will be reviewed from time to time by Professional Skin Care, and selected influencers will be informed of collaboration opportunities.
Professional Skin Care Sponsored Products
- From time to time, Professional Skin Care may offer free products (“Sponsored Products”) to Silver and Gold influencers in exchange for promotional considerations (as defined below).
- All participating influencers claiming and receiving Sponsored Products must create content (“Content”) or, if specified or required by Professional Skin Care, perform promotional activities with Sponsored Products on the Instagram, TikTok, Twitter or Pinterest account, or the YouTube channel they have registered with Professional Skin Care. Influencers must submit links as proof of Content at My Account > Order History.
- Only links to content on Instagram, TikTok , Twitter, Pinterest or YouTube will be considered valid links for proof of Content. Unless specified otherwise, links to other content or social media will not be considered as valid submissions for the purposes of this program.
- Sponsored Products offered are only available while supplies last on a first-come, first-served basis. Only the product option (color, size, etc.) indicated as “free” qualifies as a Sponsored Product. Alternative options do not count as Sponsored Products and will not be given for free.
- Claiming Sponsored Products will only be possible during the time period announced on the Professional Skin Care Influencer page.
- Influencers may only request ONE (1) Sponsored Product per calendar month.
- If an influencer claims a Sponsored Product, and the product is re-offered at any later date, then the influencer is prohibited from claiming the product an additional time. Influencers may only request a specific Sponsored Product ONE (1) time.
- When the influencer adds a Sponsored Product to their Shopping Bag, the item's sale price will be adjusted to “free” automatically if the item is still available.
- Due to limited supplies of Sponsored Products, requests for reshipment will not be honored under any circumstances.
- If supplies of a Sponsored Product are exhausted, or its promotion period ends, the item price will automatically return to the regular price without further notice. If this occurs while a Sponsored Product is placed in a Shopping Bag, the item will automatically be removed.
- If an influencer chooses to check out with only a Sponsored Product in their shopping bag, they are required to pay shipping fees and other miscellaneous or ancillary fees (if any).
- Sponsored Products are non-transferable, and may not be redeemed or resold for cash or Professional Skin Care Credit. Requests to change or cancel existing orders to add a Sponsored Product will not be entertained. Sponsored Products cannot be added to an influencer’s order if the order has already been placed.
How We Share Your Information
Except as described in this privacy policy, Professional Skin Care will not share your personal information with third parties unless you have consented to the disclosure or under the following limited circumstances.
Within Our Corporate Group
Professional Skin Care may share your personal information with other companies in our corporate group.
We have a legitimate interest in sharing your information for internal administrative purposes, in particular to offer the products and services on our website and mobile app and to deal with any inquiries in an efficient and high-quality manner. If you or the relevant Data Controller are located in the EEA, you have the right to object, on grounds relating to your particular situation, at any time to such sharing. To exercise this right you may at any time contact us as provided under "How To Contact Us" below.
Business Transfers
If Professional Skin Care is acquired by or merges with another company, Professional Skin Care may transfer personal information to that company (including transfers made as part of insolvency or bankruptcy proceedings). In such an event, Professional Skin Care will notify you before your personal information is transferred if this information would become subject to a materially different privacy policy.
Service Providers
Professional Skin Care may from time to time share the information we collect from and about you with other third-parties that provide support services to us, or that help us market our products and services. Examples are shipping vendors, billing and refund vendors, payment card processors, promoters and administrators of sweepstakes, contests, giveaways and promotions, and companies that help us improve our product and service offerings and our websites. These companies may need information about you in order to perform their functions. These companies are not authorised to use the information we share with them for any other purpose. In some cases Professional Skin Care and third-party service providers may share tracking information, including your IP address, and Professional Skin Care may provide information about your order to the website that has referred you to Professional Skin Care (and the referral network utilised by such website), to facilitate calculation of any commissions payable by Professional Skin Care.
Aggregate Information
Professional Skin Care may provide aggregate statistics about our customers, sales, traffic patterns, and related website information to third parties, but these statistics will not include any personally identifying information.
Collection and Use of Content
- Content related to Professional Skin Care, including but not limited to Content featuring Sponsored Products, that a Professional Skin Care Influencer produces for their social media channels or Content submitted directly to Professional Skin Care by the influencer may be collected by Professional Skin Carefor its own use (including, but not limited to, for marketing purposes). Such Content may consist of such YouTube or TikTok videos, Instagram posts or other social media posts, including text, images, video, and post data created by the influencer that mention Professional Skin Care as a sponsor or partner, use Professional Skin Care in a hashtag (e.g., #Professional Skin Care or #prof.skincare), or feature Sponsored Products or other products received from Professional Skin Care as a part of the Program.
- As a Professional Skin Care Influencer and in consideration of being admitted to the Program, you agree to grant Professional Skin Care a non-exclusive and irrevocable right to collect your Content from social media channels and the Professional Skin Care website for marketing, promotional, or analysis purposes. You also agree to grant Professional Skin Care’s business partners a non-exclusive and irrevocable right to publish your Content for marketing, promotional or analysis purposes. Your granting of such rights does not constitute an agreement that any specific Content will be published by Professional Skin Care or Professional Skin Care’s business partners. Any use or publication of your Content shall be at the discretion of Professional Skin Care or Professional Skin Care’s business partners.
- If you do not agree to the collection and use of your Content, you may inform Professional Skin Care and choose to withdraw from the Program anytime.
Membership and status suspension and banning
- Influencers will be banned from the Program if they create content featuring Professional Skin Care products or the Professional Skin Care brand name that also includes the following:
- Curses, obscenities or profanity
- Racist or discriminatory content
- Sexual content such as nudity or sexually explicit images or video
- Comments responding to or copying content created by other influencers or content creators
- “Spam” content
- Off-topic discussion
- Influencers will be automatically banned from the Program if they are determined by Professional Skin Care to have caused brand damage by posting and spreading inappropriate content, such as the examples previously listed, via comments or private messages on any social media channels, or have conducted themselves in a manner that could be interpreted as bringing Professional Skin Care into disrepute.
- Influencers will be suspended from claiming Sponsored Products if they request more than one (1) Sponsored Product in a calendar month.
- When claiming Sponsored Products, Influencers will be granted a quota of TWO (2) Sponsored Products that do not have proof of Content. If an influencer receives two Sponsored Products without submitting proof of Content, they will be suspended from the right to claim other Sponsored Products until proof of Content is submitted at My Account > Order History.
- Influencers will be banned from the Program if they perform any of the following actions after claiming Sponsored Products:
- Resell a Sponsored Product to a third party
- Deliberately submit incorrect or invalid proof of Content
- Professioanl Skin Care reserves the right to immediately void Commission, suspend or ban influencers, and/or void Professional Skin Caremembership (including “Professional Skin Care Influencer” status) if any fraudulent activity, abuse or conduct, including but not limited to the examples listed above, is detected or suspected.
Continuation or Transfer of the Program
- You acknowledge and agree that Professional Skin Care reserves the right at its sole discretion to transfer, assign or handover (the “Transfer”) the Program and/or all or any part of its underlying interest and rights (including your eligibility, participation and/or membership in the Program and the underlying content) to another affiliate within the same group structure of Professional Skin Care.
- Professional Skin Care shall notify its influencers of the Transfer in advance (including the new Terms & Conditions, if applicable) by public posting as appropriate, and if the influencer does not agree to the Transfer and/or to be bound by the new Terms & Conditions, the influencer may inform Professional Skin Care within the designated timeframe and choose to withdraw from the Program accordingly. Otherwise, all then eligible influencers shall be automatically enrolled into the new Program according to the then Terms & Conditions (as appropriate).
Liability Disclaimer
- By requesting to join the Program you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions.
- Only Professional Skin Care accounts verified with an email address and social media profile can be associated with the Program. Once enrolled in the Program, you will not be eligible to join any other affiliate platforms. Professional Skin Care reserves the right to void Commission, disqualify Professional Skin Care Influencer membership and/or, in extreme cases, take legal actions if any fraudulent activity or abuse is detected or suspected.
- Professional Skin Care reserves the right to terminate, discontinue, modify or cancel the Program at any time and in its sole discretion without notice to you. However, Professional Skin Care will make reasonable efforts to notify members of these changes. Any changes or modifications will be effective immediately upon public posting of the revisions.
- You agree to undertake to obtain and maintain any necessary and applicable licenses and permits required in your jurisdiction to be an influencer, and will indemnify Professional Skin Care against all claims, liabilities, suits, losses, damage and expenses, including costs and reasonable attorney fees, relating to or resulting from failure to obtain or maintain the necessary licenses and permits.
- Should there be any disputes regarding these Terms & Conditions, Professional Skin Care’s decision is final.
- These Terms & Conditions and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, and all relevant parties shall submit to the jurisdiction of the courts of the Hong Kong Special Administrative Region.
- If discrepancies exist between the English Terms & Conditions and other language versions, the English version shall prevail.
